Industry UpdatesNew York Agrees to Delay All-Electric Buildings Act in Court FilingMajor Victory: New York Agrees to Suspend Gas Ban Through Conclusion of Appellate Litigation On November 12, 2025, a coalition led by the National Propane Gas Association, the New York Propane Gas Association, and Mulhern Gas of Hudson, NY challenging the New York state gas ban entered into a settlement with the state to suspend the gas ban until the conclusion of appellate litigation. This comes after our coalition filed an injunction petition to suspend the law pending appeal before the U.S. Court of Appeals for the Second Circuit. The New York state All-Electric Buildings Act was previously set to take effect on January 1, 2026 and would have banned fuel gas infrastructure and gas appliances in most newly constructed buildings, including all residences. Buried in the document was the all-electric building act, which will outlaw fossil fueled appliances in new construction beginning December 31 2025. NYSDOH UpdateOn Monday, April 20, NYS Supreme Court Justice Christina Ryba issued her decision in the matter of NYPGA, et. al. vs. NYS Department of Health (NYSDOH) regarding the location of underground propane tanks (attached). Her decision was an unqualified victory for the NYPGA and the propane industry at large.
